Simple Possession – simple possession is when a person is caught with a nominal amount of a Controlled Drug and does not have any other indicia of drug sales (scales, multiple baggies, etc.). Simple possession can be a felony or misdemeanor, depending on criminal history and drug classification.
Possession with Intent – you may be charged with possession with intent if you have a large amount of a controlled drug or if you have indicia that you are selling. Some clues law enforcement look for are scales, multiple baggies, text messages, large amounts of cash and other things.
Trafficking – Trafficking is possession plus the requisite weight amount. In Oklahoma State Court trafficking weights are as follows:
- Marijuana – 25 lbs; aggravated if over 1,000 lbs.
- Cocaine – 28 grams; aggravated if over 449 grams.
- Heroin – 10 grams;
- Molly – 30 capsules or 10 grams.
